Terms and Conditions (UK) — Art By Joanne (www.artbyjoanne.co.uk)

These Terms and Conditions apply to the use of this website and to purchases made via www.artbyjoanne.co.uk(“Website”). The Website showcases and sells original artworks and limited edition Giclée prints by Joanne (“we”, “us”, “our”). 
By using the Website and/or placing an order, you agree to these Terms.
1) About us
The Website is operated as “Art By Joanne”. 
If you need to contact us, use the contact details on the Website contact page.
2) Website use

  1. You must use the Website lawfully and must not misuse it (including attempting to gain unauthorised access, introducing viruses, or interfering with its operation).

  2. We may update, change, suspend, or withdraw the Website (in whole or part) at any time without notice.

3) Product information

  1. Products may include original artworks and limited edition mounted and signed Giclée prints (including A3 editions where stated). 

  2. Colours may vary slightly from what you see on screen due to device settings and display differences.

  3. Any dimensions, materials, edition sizes, and availability shown on a product page form part of the product description.

4) Ordering

  1. Orders are placed through the Website’s checkout process.

  2. An order is an offer to buy. A contract is formed when we accept your order (normally by sending an order confirmation or dispatch confirmation).

  3. We may refuse or cancel an order if:

    • a product is out of stock or withdrawn;

    • there is an error in pricing or description; or

    • we reasonably suspect fraud or unauthorised activity.
      If we cancel, we will refund any sums paid for the cancelled item(s).

5) Prices and payment

  1. Prices are shown in pounds sterling (GBP) (e.g., £100.00, £190.00, £275.00, £475.00). 

  2. Prices may change at any time, but changes will not affect orders already accepted.

  3. Payment must be made in full at the time of ordering using the payment methods made available at checkout.

6) Delivery

  1. Delivery options, costs, and estimated timescales are shown at checkout (or communicated to you).

  2. Any delivery times are estimates, not guarantees.

  3. Risk in the goods passes to you when the goods are delivered to the address you provided.

  4. Ownership passes to you once we have received full payment (including any delivery charges).

  5. Print lead times: where a product page states a lead time (for example, limited edition Giclée prints available with a lead time), that lead time applies before dispatch. 

7) Returns, cancellations, and refunds (UK consumers)
This section applies if you are buying as a consumer (not in the course of business).
7.1 Your right to cancel (distance sales)

  1. You have the right to cancel most online purchases within 14 days without giving any reason. The cancellation period ends 14 days after:

    • the day you receive the goods; or

    • if your order is delivered in multiple parcels, the day you receive the last parcel.

  2. To cancel, you must notify us clearly (for example via the Website contact page).

  3. You must return goods to us without undue delay and within 14 days of telling us you wish to cancel.

7.2 Effects of cancellation

  1. If you cancel, we will refund the price paid for the goods and the standard outbound delivery cost (if applicable), using the same payment method, within 14 days of:

    • receiving the returned goods; or

    • you providing evidence of having sent the goods back, whichever is earlier.

  2. You are responsible for return postage costs unless the goods are faulty or not as described.

7.3 Deductions
We may reduce your refund if the goods show signs of handling beyond what is necessary to establish their nature, characteristics, and functioning.
7.4 Exceptions
The 14-day cancellation right does not apply to:

  • custom-made or clearly personalised items (including commissioned artwork or bespoke prints created to your specification). 

7.5 Faulty or misdescribed goods
Nothing in these Terms affects your statutory rights under UK consumer law. If goods are faulty or not as described, contact us and we will remedy in line with your legal rights.
8) Commissions

  1. Commission availability and examples are shown on the Website. 

  2. Commission pricing, timelines, and any deposits will be agreed in writing before work begins.

  3. Unless agreed otherwise, commissioned work is treated as personalised and is non-cancellable once work has started (see section 7.4).

9) Intellectual property

  1. All content on the Website (including images of artworks, text, logos, and layout) is owned by or licensed to us and is protected by copyright and other intellectual property rights. 

  2. You may view, download, or print Website pages for personal use only. You must not copy, reproduce, distribute, or exploit any content for commercial purposes without prior written permission.

  3. Purchasing an artwork or print does not transfer copyright. Copyright remains with the artist unless explicitly agreed in writing.

10) Promotions and exhibitions
Information about exhibitions and third-party galleries is provided for information only and may change; please check the organiser’s details. 
11) Links to third parties
The Website may contain links to third-party sites (e.g., exhibition venues or galleries). We are not responsible for third-party content, policies, or availability. 
12) Liability

  1. We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

  2. Subject to clause 12.1, we are not liable for losses not caused by us, or for indirect or consequential losses.

  3. If you are a consumer, nothing in these Terms limits your statutory rights.

13) Privacy and cookies
Your personal data will be handled in line with our Privacy/Cookie information (where provided on the Website). If no separate policy is posted, contact us to request details of how your data is used.
14) Changes to these Terms
We may update these Terms from time to time by posting an updated version on the Website. The version in force at the time you place an order will apply to that order.
15) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. If you are a consumer, you can bring legal proceedings in the UK courts that apply to where you live.
